This study examines the issue of ordination for sexual minorities in contemporary Korean Buddhism in light of the normative structure of the Vinaya tradition. It focuses in particular on the functional character of antarāyika-dhamma . Often translated as “impediments to ordination,” antarāyika-dhamma functions in practice as a set of disqualifying conditions that determine eligibility for ordination and preserve the integrity of the Saṅgha. The study further analyzes how this normative logic has been received and implemented in the regulations of the Jogye Order (曹溪宗 宗法).
In the Vinaya,antarāyika-dhamma operates through a dual mechanism: it restricts eligibility for ordination in advance and rectifies improper ordinations afterward through nāsanā (expulsion). This structure is also evident in the regulations concerning paṇḍaka and ubhatobyañjanaka . These provisions did not arise as fixed grounds for exclusion based on inherent bodily traits; rather, they emerged from practical concerns regarding the effects of such conditions on monastic practice, communal order, and the prevention of public reproach (譏嫌).
From this perspective, the Jogye Order’s provisions concerning “neutral gender” (中性) and persons whose “physical condition is deemed unbecoming of the dignity of the Saṅgha” subsume distinct evaluative criteria within a single category and therefore fail to provide sufficiently clear standards or procedures for determining eligibility. In particular, the conflation ofwiyi (威儀), meaning cultivated monastic comportment, with wisin (威信), referring to outward dignity or prestige, obscures the criteria for application.
In response, this study proposes a more differentiated specification of eligibility criteria, refinement of deliberative procedures so that the consensual spirit ofkamma (羯磨) is more clearly reflected, and phased institutional implementation accompanied by ongoing evaluation. By reconstructing the normative spirit of the Vinaya within modern monastic institutions, this study offers an interpretive framework for sustaining both the identity of the Saṅgha and its social credibility under changing social conditions.

본 연구는 율장 전통의 규범 구조에 비추어 현대 한국불교의 성소수자 수계 문제를 고찰한다. 특히 수계 결격 사유인 차법(遮法, antarāyika-dhamma)의 기능적 성격에 주목하여 그 규범 논리가 대한불교조계종 종법 체계에서 어떻게 수용되고 운용되는지를 검토한다. 율장에서 차법은 수계 자격을 사전에 한정하고 부적격 수계를 사후에 멸빈(nāsanā)으로 바로잡는 이중 구조 속에서 기능한다. 이러한 구조는 빤다까(paṇḍaka, 黃門)와 우바토뱐자나까(ubhatobyañjanaka , 二根者)에 관한 규정에서도 확인된다. 이들 규정은 특정 신체 상태를 고정된 배제의 근거로 삼기보다 수행 환경에 미치는 영향, 승가 공동체 질서 유지, 그리고 대중의 비난을 예방하려는 실천적 요구 속에서 제정된 것이다. 이러한 규정의 성격은 차법이 단순한 수계 결격 사유가 아니라 승가의 청정성과 사회적 신뢰 유지를 위해 수계의 적법성을 가늠하는 자격 판단 규범으로 기능하고 있음을 드러낸다. 이러한 관점에서 조계종 종법의 ‘중성’ 및 ‘신체조건이 승가로서의 위신상 부적당한 자’ 조항을 검토하면 해당 규정은 서로 다른 층위의 판단 요소를 단일 범주로 포괄함으로써 명확한 자격 기준과 절차를 충분히 제시하지 못하고 있음을 보여준다. 특히 수행자의 실천적 덕목인 ‘위의(威儀)’가 외형적 조건을 가리키는 ‘위신(威信)’ 개념과 혼용되면서 조항의 적용 기준을 모호하게 만들고, 그 결과 해석의 편차와 자의적 판단의 가능성을 내포하게 된다. 이에 본 연구는 성소수자 수계의 현대적 적용을 위한 방안으로 자격 판단 기준의 다층적 구체화와 갈마(羯磨, kamma )의 합의 정신이 보다 명확히 드러나도록 하는 심사 절차의 보완, 그리고 단계적 시행과 평가를 통한 제도적 정착 방안을 제안한다. 이러한 논의는 성소수자의 수계 가능 여부를 넘어 율장의 규범 정신을 현대 종단 제도 속에서 재구성함으로써 변화하는 사회적 조건 속에서 승가의 정체성과 사회적 신뢰를 함께 유지하기 위한 해석적 토대를 마련한다.
